Introduction

The Department of Basic Education (DBE) is seeking a seasoned legal professional to lead its Legal and Legislative Services division as Chief Director, based in Pretoria. This is a high-level opportunity for admitted attorneys or advocates with strong public sector legal experience. Applications close on 17 August 2026.

About the Company

This Senior Management Service (SMS) position falls under the Finance and Administration branch, offering an inclusive salary package of R1 554 696 per annum. The successful candidate will provide strategic legal leadership across litigation, legislative drafting, and legal advisory services for the Department.

Responsibilities

• Provide strategic leadership to the Chief Directorate: Legal and Legislative Services
• Deliver high-level legal advice to the Minister, Director-General, and the Department
• Manage litigation involving the Minister, DG, and Department, including instructing the State Attorney
• Oversee drafting, amendment, and interpretation of education legislation and regulations
• Coordinate and monitor the Department's legislative programme
• Provide legal support to provincial education departments where required
• Advise on governance and administration of statutory bodies in the basic education portfolio
• Draft, review, and negotiate national and international agreements and MOUs
• Manage legal risk, compliance monitoring, and implementation of court orders
• Oversee the Chief Directorate's human, financial, and operational resources

Required Qualifications

• Bachelor of Laws (LLB) or equivalent legal qualification (NQF Level 7, SAQA recognized)
• Admission as an attorney or advocate in South Africa, in good standing
• Minimum 10 years' post-qualification legal experience, with at least 5 years at senior managerial level
• Experience in legislation, policy, or litigation within the education or comparable public sector
• Demonstrable experience in education law is essential
• Experience in constitutional law, administrative law, and legislative drafting is an advantage
• Excellent written and verbal communication, research, and analytical skills
• Strong strategic leadership and stakeholder management capabilities
• Must complete the SMS Pre-entry Programme (Nyukela Certificate)

ASSISTANT DIRECTOR (EDUCATOR PLANNING) - Job Description

Introduction

All shortlisted candidates, including the SMS, shall undertake two pre-entry assessments. One will be a practical exercise to determine a candidate’s suitability based on the post’s technical and generic requirements and the other must be an integrity (ethical conduct) assessment. The successful candidate must sign an annual performance agreement, annually disclose his/ her financial interests and be subjected to a security clearance.

Responsibilities

The successful candidate will be responsible for supporting forecasting of
short, medium, and long-term educator demand in the sector; Analyzing and
monitoring educator allocation and mobility trends; Assisting in commissioning
research on teacher demand, supply and utilization; Developing and
supporting systems and tools for effective educator demand planning;
Monitoring and managing educator utilization to ensure every class has a
qualified teacher; Monitoring and reporting on Post Provisioning processes in
the sector; Overseeing implementation of policies on educator remuneration,
including budget and salary agreements; Co-ordinating and managing work
related to the HEDCOM Subcommittee on Human Resource Matters;

 
Managing the National Recruitment Database and respond to ad hoc HR data
requests, parliamentary questions, media queries, and public inquiries;
Drafting reports and submissions in line with the work associated with the post;
Handling incoming HR-related queries and liaising with provincial education
departments; Providing input for quarterly and monthly reports.

Required Qualifications

The applicants must be in possession of an appropriate three-year (NQF level
6) post matric qualification or equivalent qualification as recognised by SAQA
in Human Resource Planning / Management; Three (3) years relevant
supervisory experience in human resource management within the education
sector; In-depth understanding of human resource planning and provisioning
in the public education sector;

 Experience in data capturing, management and
analysis for compiling accurate reports; 

Understanding the post Provisioning
Model, including norms and standards for allocating teaching posts in public
schools; Ability to work with the National Recruitment Database or large
databases; Ability to work well under pressure; Ability to maintain attention to
details; Strong data analysis skills; Knowledge of Micro-soft excel and other
micro-soft office application; Advanced technical skills in data analysis and
report compilation; 

Communication skills (verbal and written); Strong
interpersonal relations; Enthusiasm, commitment, flexibility, drive, eager to
learn and self-starter ; A valid driver's license; Willingness to travel.
